The Court is in recess until Wednesday 4 June, when the appeal of R (Sandiford) v The Secretary of State for Foreign and Commonwealth Affairs will be heard. This will be in courtroom 2 from 10.30am for one day. This concerns whether the Secretary of State’s decision not to fund legal services for someone facing the death penalty in criminal proceedings abroad was unlawful. The appellant was convicted of drug trafficking offences in Indonesia and sentenced to death. The respondent has a strict policy not to provide legal funding in such cases, even where the death penalty is applied.

 

On Thursday, the Court will hear the appeal of AIB Group (UK) plc v Mark Redler & Co Solicitors for half a day to one day. This will decide whether the appellant is entitled to compensation for the whole funds of a loan following a breach of trust by the respondent or whether they can only recover their actual losses.
