New Judgment: Global Process Systems Inc & Anor v Berhad UKSC 5
01 Tuesday Feb 2011
On appeal from: EWCA Civ 1398
The issue before the Supreme Court was whether the proximate cause of the loss was an insured peril, in the form of the stresses put upon the oil rig by the height and direction of the waves encountered on the voyage, or inherent vice in the subject matter insured. The Supreme Court unanimously dismissed the appeal. The cause of the loss was an insured peril rather than inherent vice.
