On appeal from: [2008] EWCA Civ 287. On a claim for authorship and copyright in Procul Harum’s song ‘A Whiter Shade of Pale’.
Appeal allowed. The respondents could not show any prejudice from the delay in making claim for a share in the musical copyright. Even if they could do so, they had no answer to the finding that the benefit they obtained from the delay would outweigh any such prejudice.
