On Wednesday 27 November 2019, the Court will hand down judgment in Royal Mail Group Ltd v Jhuti. This case considers the correct test to be applied when an employee (A) alleges that they have been unfairly dismissed by reason of having made a public interest disclosure. In particular, if, and in what circumstances, the actions of an employee (B) are treated as those of B, or attributed to, the employer of A and B.

On Wednesday 27 November 2019, the Court will also hand down judgment in R (on the application of Hemmati & Ors) (AP) v Secretary of State for the Home Department. This case considers whether the Secretary of State’s published policy in Chapter 55 of the Enforcement Instructions and Guidance satisfied the requirements of Article 2(n) and Article 28 of the Dublin III Regulation. If not, whether damages are payable in respect of the detention of the Respondents either for the tort of false imprisonment or pursuant to EU law under the principle established by the Court of Justice of the European Union in the Factortame case.

On Wednesday 27 November 2019, there will be a directions hearing in the appeal of A Reference by the Attorney General for Northern Ireland of devolution issues to the Supreme Court pursuant to Paragraph 34 of Schedule 10 to the Northern Ireland Act 1998. This case considers whether the Reference raises a devolution issue (per Schedule 10, paragraph 1 of the Northern Ireland Act 1998).

On Thursday 28 November 2019, the Court will hear the appeal of Barclays Bank plc v Various Claimants. This appeal considers whether a defendant employer is liable for sexual assaults committed by a medical practitioner in the course of medical examinations carried out at the employer’s request either before or during the claimant’s employment.

On Monday 25 November 2019, the Privy Council will hear the appeal of De Zwarte Band & Anor v Kanhai & Anor (Trinidad and Tobago). This appeal considers whether a judgment debtor’s legal and beneficial interest is to be determined as at the date of registration of the judgment or whether it can be altered by a subsequent determination in matrimonial property proceedings.

On Wednesday 20 November 2019, the Privy Council will hear the appeal of Saunders v The Queen (Bahamas). This appeal considers whether the Court of Appeal was wrong to dismiss the appellant’s appeal without a hearing; whether the criminal proceedings were vitiated by a procedural error at the committal stage; and whether the appellant was denied a fair trial because DNA samples were not provided to the defence.
