On Tuesday 23 June 2020, the Supreme Court will hear the appeal of Okpabi & Ors v Royal Dutch Shell Plc & Anor. This appeal considers the circumstances in which the UK-domiciled parent company of a multi-national group of companies may owe a common law duty of care to individuals who allegedly suffer serious harm as a result of alleged systemic health, safety and environmental failings of one of its overseas subsidiaries as the operator of a joint venture operation.

On Wednesday 24 June 2020, the Supreme Court will hand down judgment in Regeneron Pharmaceuticals Inc v Kymab Ltd. This appeal concerns whether the relevant patents are invalid for insufficiency because they did not enable the ordinary skilled person to work the claimed invention across the breadth of the claims.

On Wednesday 24 June 2020, the Supreme Court will also hand down judgment in The Advocate General representing the Commissioners of HMRC v KE Entertainments Ltd (Scotland). This appeal considers whether the taxpayer (K E Entertainment Ltd)’s claim to a repayment of value added tax (VAT) fell within the scope of the Principal VAT Directive, Articles 73 and 90, together with (if necessary) VAT Regulation 38 (as the taxpayer contends) or within VAT Act section 80 and is therefore time-barred (as the Commissioners contend).

On Wednesday 24 June 2020, the Privy Council will hear the appeal of Yearwood v Yearwood (Antigua & Barbuda). This appeal considers, inter alia, whether orders by the High Court of England and Wales in family proceedings can be registered in Antigua and Barbuda under the Reciprocal Enforcement of Judgments Act.

On Thursday 25 June 2020, the Supreme Court will hear the appeal of R (Highbury Poultry Farm Produce Ltd) v CPS. This appeal considers whether proof of an offence contrary to Regulation 30(1)(g) of the Welfare of Animals at the Time of Killing (England) Regulations 2015 brought against a business operator as defined in Regulation (EC) No. 1099/2009 on the protection of animals at the time of killing requires proof of mens rea and/or some culpable act or omission on the part of the business operator.
