There only one case listed in the Supreme Court this week: Secretary of State for Communities and Local Government v Welwyn Hatfield Borough Council. It will be heard on Monday 7 and Tuesday 8 February 2011 by Lords Phillips, Rodger and Walker, Lady Hale and Lords Brown, Mance and Clarke. This case concerns the building of a dwelling house on green belt land with planning permission that allowed the construction of a hay barn. The bench will consider the application of s.171B(2) Town and Country Planning Act 1990 to a building only constructed and used for the purpose of a single dwelling house and decide whether the conduct of the second respondent was such as to deprive him of the right to apply for a certificate of lawful use.  Our case preview is here and here are the Supreme Court case details.
