Hearings in the Supreme Court are now shown live on the Court’s website.
On Monday 21 and Tuesday 22 May, the Judicial Committee of the Privy Council will hear the appeal of Browne v Munokoa & Anor (Cook Islands). This appeal will consider whether the respondent, who is the adopted son of the deceased and who is not related to him by blood, may succeed to the freehold title to the customary land of the deceased, and the proper interpretation and effect, if any, of the Constitution of the Cook Islands in this case. This will be heard in Courtroom 3.
On Wednesday 23 May, the Supreme Court will hear the appeal of R v MacKinlay & Ors. This appeal will consider whether property, goods, services or facilities transferred to or provided for the use of benefit of a candidate free of charge or at a discount (as identified in the Representation of the People Act 1983, s 90C(1)(a) (as amended)) only fall to be declared as election expenses if they have been authorised by the candidate, his election agent, or someone authorised by either or both of them. This will be heard in Courtroom 2.
On Tuesday 22 May, the Supreme Court will hand down the judgment in Navigators Insurance Company Ltd & Ors v Atlasnavios-Navegacao LDA (formerly Bnavios-Navegacao LDA). The hand down panel will be Lord Mance, Lord Sumption and Lord Briggs. This appeal considered whether clause 4.1.5 of the standard form Institute War and Strikes Clauses 1/10/83, which excludes losses arising from detainment by reasons of infringement of customs regulations, operates to exclude a claim where the infringement of customs regulations occurred due to an insured peril.
