On Tuesday 14 February, the Supreme Court will hear the appeal of Poshteh v Royal Borough of Kensington and Chelsea. This will consider the scope of the enquiries required of a Local Authority when making decisions in homelessness cases to which Equality Act 2010, 2 149 applies; and the standard of review to be applied by court when reviewing decisions of the Local Authority in such cases. This will be heard in Courtroom 2.

On Wednesday 15 to Thursday 16 February, the Supreme Court will hear the appeals of R (Kiarie) v Secretary of State for the Home Department and R (Byndloss) v Secretary of State for the Home Department. These will consider whether the Nationality, Immigration and Asylum Act 2002, s 94B complies with the ECHR, art 8 procedural and substantive protections. This will be heard in Courtroom 2.

On Wednesday 15 February, the Supreme Court will hand down the judgment in R (Hicks & Ors) v Commissioner of Police for the Metropolis. The hand down panel will be Lord Mance, Lord Carnwath and Lord Toulson. This case considered whether the Court of Appeal was correct to hold that the appellants’ arrests and detention were lawful under ECHR, art 5(1)(c) or alternatively under art 5(1)(b).
