On Tuesday 12 and Wednesday 13 November 2019, the Supreme Court will hear the appeal of Halliburton Company v Chubb Bermuda Insurance Ltd (Formerly known as Ace Bermuda Insurance Ltd.) This case examines the circumstances in which an arbitrator should make disclosure of circumstances which may give rise to justifiable doubts as to his impartiality. This will be heard in Court 1.

On Tuesday 12 November 2019, the Court will also hear the appeal of R (on the application of Jalloh (Liberia)) v Secretary of State for the Home Department. This appeal considers whether the imposition of a curfew requirement on a person subject to deportation amounts to ‘imprisonment’ for the purpose of establishing the tort of false imprisonment. This will be heard in Court 2.

On Wednesday 13 November 2019, the Court will hand down judgment in RR (AP) v Secretary of State for Work and Pensions. This appeal considers whether statutory authorities, including the First-tier Tribunal and Upper Tribunal, have the power or duty to calculate entitlement to housing benefit without making deductions for under-occupancy, so as not to violate a claimant’s rights under the European Convention on Human Rights; and, if so, the extent to which the payment of discretionary housing payments are relevant to the task of the statutory authorities in calculating entitlement.

On Wednesday 13 and Thursday 14 November 2019, the Court will hear the appeal of ABC (AP) v Principal Reporter & Anor (Scotland). This appeal raises the issue of whether a declaration of incompatibility should be made in respect of section 81(3) of the Children’s Hearings (Scotland) Act 2011 and alternatively whether section 81(3) needs to be read down so as to enable a sibling to become a deemed relevant person.

On Wednesday 13 and Thursday 14 November 2019, the Court will hear the appeal of In the matter of XY (AP) (Scotland). This appeal considers whether the provisions of the Children’s Hearings (Scotland) Act 2011 violate Articles 6 and 8 of the ECHR such that they are not law for the purposes of section 29 of the Scotland Act 1998 and whether a declaration of incompatibility should be made in respect of these provisions.

On Wednesday 13 November 2019, the Privy Council will hear the appeal of Ayers-Caesar v Judicial and Legal Service Commission (Trinidad and Tobago). This appeal considers whether the Court of Appeal was right to find that the first instance judge had erred in refusing to grant the Respondent leave: to amend her claim; and to cross-examine the Appellant’s deponents. On Thursday 14 November 2019, the Privy Council will also hear the appeal of Attorney General of Trinidad & Tobago v Ayers-Caesar (Trinidad & Tobago). This case concerns the appointment of a High Court judge who, following her identification of matters she had heard part-time as a Magistrate, was asked to resign.
