On Wednesday 13 May 2015 the Court will hand down judgment in the following: Gaughran v The Chief Constable of the Police Service of Northern Ireland regarding the indefinite retention of fingerprints, photographs, DNA samples and DNA profiles of an individual convicted in Northern Ireland; the joined appeals of Hotak v London Borough of Southwark; Johnson v Solihull; and Kanu v London Borough of Southwark involving what the correct test should be when trying to establish if a person should have priority need status for the purposes of the Housing Act 1996, s19, in particular how to determine whether they were “vulnerable”; and Starbucks (HK) Ltd & Anor v British Sky Broadcasting Group plc & Ors regarding a claim against trade mark infringement and passing off. These will be handed down in Court 2 from 9.45am.

On Wednesday the Court will also hear the appeal In the matter of AR (Children) (Scotland) regarding proceedings under the Child Abduction and Custody Act 1985 to secure the return of the appellant’s children from Scotland to France, where he was resident. The Court must consider the significance of parental intention in the determination of the habitual residence of a child for the purposes of an application under the Hague convention. It will be heard in Court 2 from 10.30am.

On Wednesday it will also hear the appeal of Edenred (UK Group) Ltd & Anor v Her Majesty’s Treasury & Ors regarding a challenge to the allocating provision of childcare accounts and associated services to NSI, to be delivered under a pre-existing outsourcing contract with Atos. The appellants argued that this was incompatible with the requirement under EU law that new public services contracts be subject to a tender procedure. This will be heard in Court 1 from 10.30am and will continue on Thursday.

On Monday 11 May the Privy Council will hand down judgment in Brantley & Ors v Constituency Boundaries Commission & Ors (St Christopher and Nevis). This will be handed down in Court 1 from 10.30am. It will also hear the appeal of Misick & Ors v The Queen (Turks and Caicos) regarding whether a judge appointed for a limited period has sufficient security of tenure to be an “independent and impartial court”, as required by the Constitution of the Turks and Caicos Islands, and also what the standard of proof was on an application in a criminal case for trial by judge alone. This will be heard in Court 3 at 10.30am.
