On Monday 1 February 2016 the Supreme Court will hear the appeal of Abd Ali Hameed Al-Waheed v Ministry of Defence; Mohammed & Ors v Ministry of Defence & Anor concerning whether HM armed forces had the power to detain the appellants, on the ground that it was necessary for imperative reasons of security, pursuant to International Humanitarian Law applicable in a non-international armed conflict. It will be heard in Court 1 from 11am and will continue on Tuesday, Wednesday and Thursday from 10.30am.
On Wednesday 3 February it will hand down judgment in the following appeals: In the matter of B (A child) regarding the appellant’s application for their daughter, B, to be made a warden of the court because the respondent had taken her to Pakistan. The issue was whether B lost her habitual residency in the UK immediately after she left for Pakistan and if the Court of Appeal was wrong to decline to exercise the inherent jurisdiction to order B’s return to the UK; and R v Taylor regarding whether an offence is contrary to the Theft Act 1968, ss 12A(1) and 2(b), committed when, following the basic offence and before the recovery of the vehicle, the defendant drove the vehicle and, without fault in the manner of his driving, the vehicle was involved in an accident which caused injury to a person. These will be handed down in Court 2 from 9.45am.
