On Wednesday 5th April the Court will hand-down judgment in  R (on the application of Pearce and another) v Parole Board for England and Wales [2023] UKSC 13. The court will determine two questions: (i) When the Parole Board is deciding whether or not to direct the release of a prisoner on licence, can it only take into account allegations if they are proved on the balance of probabilities? (ii) Does the Parole Board’s “Guidance on Allegations” misstate the law on this issue? The hand-down will take place at 9:45am in Courtroom 1.
