From Monday 26th – Tuesday 27th June the Court will hear the case of Commissioners for His Majesty’s Revenue and Customs v Professional Game Match Officials Ltd, on appeal from [2021] EWCA Civ 1370. The Court will consider whether the relationship between a company responsible for providing football referees to the Football League and part-time referees an employment relationship so as to trigger an obligation on the company to deduct Income Tax and National Insurance from the payments it makes to the referees? The hearing will begin at 11:00am in Courtroom 1.

On Wednesday 28th June the Court will hand-down two judgments at 9:45am in Courtroom 1:

  • Unger and another (in substitution for Hasan) v Ul-Hasan (deceased) and another [2023] UKSC 22. The Court will determine whether an unadjudicated claim for financial provision under the Matrimonial and Family Proceedings Act 1984 survives the death of the respondent and can be continued against their estate.
  • R (on the application of Toraane and another) v Secretary of State for the Home Department [2023] UKSC 23. The Court will determine the territorial scope of the public sector equality duty in section 149(1) of the Equality Act 2010, which requires public authorities to have due regard to equality issues.

On Wednesday 28th – Thursday 29th June the Court will hear SkyKick UK Ltd and another v Sky Ltd and others, on appeal from [2021] EWCA Civ 1121. The Court will consider two questions: (1) What is the test for determining “bad faith” in s.3(6) of the Trade Marks Act 1994? (2) If such bad faith is found, what is the correct approach to determining the specification that the proprietor of the trademark should be permitted to retain? The hearing will begin at 10:30am in Courtroom 1.
