On Wednesday 6 November 2013 and listed for two days are the linked appeals of EM (Eritrea) & Ors v Secretary of State for the Home Department. The appellants in these matters arrived separately in the UK from Italy, having each left their home countries (Eritrea and Iran) for various reasons, including fear of persecution, ill-treatment and torture. The SSHD certified each appellant’s claim for asylum as clearly unfounded, and set removal directions for the return of each appellant to Italy pursuant to the Dublin II Regulation. The Supreme Court will determine whether the return of any of the appellants to Italy would entail a real risk of inhuman or degrading treatment in violation of ECHR, art 3; and whether the return of one particular appellant would be in violation of her right to respect for family life under ECHR, art 8.

On Wednesday 6 November 2013 the Supreme Court will hand down judgment in the following: Cotter v Commissioner for Her Majesty’s Revenue and Customs; and In the matter of “The Alexandros T” (Nos. 1, 2 and 3).
