On Wednesday 7 and Thursday 8 July, the Supreme Court will hear Alize 1954 and Anor v Allianz Elementar Versicherungs AG and Ors. This appeal will consider whether seaworthiness for the purposes of Article III Rule 1 of the Hague-Visby Rules includes navigational decisions taken by the crew taken prior to commencement of a voyage.

On Friday 9 July, the Supreme Court will hand down judgment in three cases. First, R (on the application of SC, CB and 8 children) v Secretary of State for Work and Pensions and Ors. This appeal considered whether the ‘two child limit’, a provision of primary legislation which restricts payment of amounts of subsistence benefit for children to the first two children in a family, is incompatible with the Appellants’ rights under the European Convention on Human Rights.

Second, A and B v Criminal Injuries Compensation Authority and Anor. This appeal considered whether excluding A and B, who are victims of human trafficking, from compensation under the Criminal Injuries Compensation Scheme unjustifiably discriminates against A and B, in breach of Article 14 taken with Article 4 of the European Convention on Human Rights.

Third, R (on the application of AB) v Secretary of State for Justice. This appeal considered whether the Court of Appeal erred (i) in its approach to international materials and (ii) by failing to apply a ‘strict necessity’ test when determining whether the Respondent’s treatment of the Appellant during the first 55 days of his detention at Feltham Young Offenders’ Institution breached Article 3 of the European Convention on Human Rights.
