On Tuesday 5 May 2015 the Court will hear the appeal of Secretary of State for Work & Pensions v Tolley (Deceased acting by her personal representative) concerning whether the tribunals were right to rule that the respondent was entitled to continue to receive the care component of the Disability Living Allowance when she moved permanently from the UK to Spain in 2002. This will be heard in Court 2 from 10.30am and will continue on Wednesday.

On Thursday 7 May the Court will hear the appeal of Mandalia v Secretary of State for the Home Department regarding whether the respondent was required to apply her “Evidential Flexibility” Policy in the appellant’s case to allow him the opportunity to correct an error in his application for leave to remain before refusing it. It will be heard in Court 2 from 10.30am.

On Thursday 7 May the Privy Council will hear the appeal of The Federal Republic of Brazil & Anor v Durant International Corporation & Anor (Jersey) regarding whether the Court of Appeal erred in not finding that the fund actuary’s recommendation in relation to the distribution of the surplus in the Pension Plan was contrary to the “Rules of the Plan” and Income Tax Act, s 44, and therefore erred in ruling that the surplus should be distributed according to the recommendation of the fund actuary. This will be heard in Court 3 at 10.30am.
