On Tuesday 23 October 2012 is the one day hearing of RM v The Scottish Ministers, an appeal from the Court of Session (Scotland). The appellant is detained in Leverndale Hospital and believes the conditions of his detention are excessively secure. He has petitioned for judicial review of the decision to detain him in these conditions, arguing that the respondents have failed in their statutory duty to put before the Scottish parliament regulations under the Mental Health (Care and Treatment) (Scotland) Act 2003 s 268 that would enable people in his position to apply to the Mental Health Tribunal to review their detention conditions. Case details are available here.
