There is only one appeal scheduled in the Supreme Court this week: WL Congo 1 and 2 & anr v Secretary of State for the Home Department and KM (Jamaica) v Secretary of State for the Home Department. These linked cases are scheduled to be heard over four days from Monday 15 to Thursday 18 November 2010 by Lords Phillips, Hope, Rodger, Walker, Lady Hale and Lords Brown, Collins and Kerr, and Sir John Dyson SCJ.

The court will determine whether the detention of the Appellants, WL Congo 1 and 2 and KM (Jamaica) by the Secretary of State for the Home Department (SSHD), pursuant to an unpublished administrative policy (which was inconsistent with the published policy that the SSHD purported to apply at the operative time) rendered the Appellants’ imprisonment unlawful so as to give rise to an action for unlawful imprisonment and, if so, whether the Appellants should be entitled to an award of exemplary damages. There are no appeals being heard in the Privy Council this week.

The Supreme Court has announced that hand down of judgment on Multi-Link Leisure Developments Limited (Appellant) v North Lanarkshire Council (Respondent) (Scotland) will be on Wednesday 17 November 2010. The case was heard on 12 October 2010 and here is our case preview.
