There is only one hearing in the Supreme Court this week, three linked appeals about compensation for miscarriages of justice.  The cases of R (Adams) v Secretary of State Justice; In the Matter of an Application by Eamonn MacDermott for Judicial Review (Northern Ireland); and In the Matter of an Application by Raymond Pius McCartney for Judicial Review (Northern Ireland) are being heard from Tuesday 15 to Thursday 17 February 2011 by Lords Phillips, Hope and Walker, Lady Hale and Lords Brown, Judge and Kerr.The case of R (Adams) v Secretary of State Justice addresses a case where a murder conviction was quashed on the grounds that defence counsel failed to adduce relevant evidence. The issue is whether the failure to identify relevant information that may have affected the result of criminal proceedings amounted to a miscarriage of justice thereby conferring a right to statutory compensation against the SSJ pursuant to the Criminal Justice Act 1988, s 133.  The Supreme Court case details are here.

The Northern Ireland cases of In the Matter of an Application by Eamonn MacDermott for Judicial Review; and In the Matter of an Application by Raymond Pius McCartney for Judicial Review concern convictions of murder and membership of the IRA.  At trial the appellants alleged ill-treatment by the police. The Supreme Court has not announced any judgments for hand down next week.
