On Tuesday 13 and Wednesday 14 March, the Supreme Court will hear the appeal of R (Gallagher Group Ltd & Ors) v The Competition and Markets Authority. This appeal will consider whether the principle of fair and equal treatment can require a decision-maker to replicate the effect of assurances given to one party that were made based on a mistake of legal principle in favour of other parties in a comparable position. This will be heard in Courtroom 2.

On Wednesday 7 March, the Supreme Court will hand down the judgment in the case of A v B (A Local Authority). The hand down panel will be Lady Hale, Lord Wilson and Lord Hodge. This appeal considered the scope of A’s contractual obligation of disclosure: whether the Employment Tribunal made appropriate findings to support the duty imposed and whether such duty was disproportionate given A’s right to a private life.

On Thursday 15 March, the Judicial Committee of the Privy Council will hear the appeal of Bahamasair Holdings Ltd v Messier Dowty Inc (Bahamas). This appeal will consider whether the Court of Appeal was entitled to overturn particular findings made by the trial judge including that there was a defect or inadequacy in the design of the damper ring in the shock strut of the landing gear which collapsed, and that the appellant had been aware of that problem and changed its design as a result, but failed to warn the respondent about it. If not, it will consider whether it is open to the Judicial Committee of the Privy Council to consider the issue of damages, and if so, will consider whether the appellant has proved the loss which it claims. This will be heard in Courtroom 3.
