The new Hilary term of 2011 starts with just one appeal in the Supreme Court this week.  On appeal directly from a decision of the High Court (Queen’s Bench Division), Jones v Kaney ([2010] EWHC 61 (QB)) will be heard over two days from Tuesday to Wednesday 11 – 12 January by a seven judge bench (Lords Phillips and Hope, Lady Hale and Lords Brown, Collins, Kerr and Dyson). The case arises out of a personal injury claim that involved the preparation of an expert witness report as to the psychiatric injury incurred by Jones as a result of a road traffic accident.  The issue is whether Jones’ claim was wrongly struck out on the ground that the expert witness in civil litigation enjoys immunity from a negligence suit in preparing and agreeing an expert joint statement. The Supreme Court has not announced any judgments for hand down next week.
