On Monday 10 May, the Supreme Court will hear R (on the application of SM (Rwanda) (AP)) v Secretary of State for the Home Department. This appeal will consider whether SM’s purported grant of immigration bail by the First-tier Tribunal was invalidated from the outset by defects in the Tribunal’s order, and the consequences if not.

Also on Monday 10 May the Supreme Court will hear proceedings for contempt brought by the Attorney General against Mr Tim Crosland. Mr Crosland, an environmental lawyer, acted for Plan B in the case heard at the UK Supreme Court about Heathrow’s third runway, R (on the application of Friends of the Earth ltd and Ors) v Heathrow Airport Ltd.  In summary, the contempt proceedings involve an allegation that prior to the judgment being delivered Mr Crosland in breach of confidentiality and of an embargo issued a statement to the news wire Press Association, disclosing the Supreme Court’s decision.

On Tuesday 11 and Wednesday 12 May, the Supreme Court will hear Tinkler v Commissioners for Her Majesty’s Revenue and Customs. This appeal will consider whether Tinkler is estopped by convention from denying that HMRC had opened a valid enquiry when HMRC had sent the notice to the wrong address and Tinkler’s accountants had interacted with HMRC on the basis an enquiry had been opened.
