Listed for two days from Monday 9 December 2013 is the appeal of R (T & Anor) v SSHD & Anor. This matter concerns the ECHR, art 8 implications of criminal record disclosure.
On Wednesday 11 until the afternoon of Thursday 12 December 2013 are the linked Northern Irish appeals of R v Mackle (Nos. 1, 2 and 3) and R v McLaughlin. The appellants each pleaded guilty to being concerned in the fraudulent evasion of duty in relation to cigarette smuggling operations, and further consented to the court imposing confiscation orders. The Supreme Court will clarify whether a defendant is bound by the terms of a confiscation order in circumstances where they have pleaded guilty to being knowingly concerned in the fraudulent evasion of duty and consented, with the benefit of legal advice, to the making of a confiscation order in circumstances where the Crown is not required to prove that property or a pecuniary advantage was obtained in connection with the charged criminal conduct. Another issue for consideration is whether a defendant who knowingly comes into physical possession of goods they know the duty has been evaded on, and plays an active role in the handling of those goods, benefits from their criminal activity by obtaining those goods for the purposes of the Proceeds of Crime (Northern Ireland) Order 1996, art 8.
On Wednesday 11 December 2013 the Supreme Court will hand down judgment in the following: R (Hodkin & Anor) v Registrar of Births, Deaths and Marriages; and R (Edwards & Anor) v Environment Agency & Ors.
In the Privy Council the appeal of Chatham Bay Club Limited & Anor v AG of Saint Vincent and the Grenadines was listed on Tuesday 10 December 2013, but the matter has now settled.
