From today listed for two days in Courtroom 1 is the appeal of Commissioners for Her Majesty’s Revenue and Customs v Marks and Spencer plc. There are currently no case details available for this matter.
In Courtroom 2 on Tuesday 26 and Wednesday 27 November 2013 is A v Secretary of State for the Home Department, on appeal from the Court of Session.
From Wednesday 27 until Thursday 28 November is the appeal of R (Eastenders Cash and Carry plc & Ors) v Commissioners for Her Majesty’s Revenue and Customs. HMRC seized alcohol-related goods from the respondents’ warehouses, some of which was returned to the respondents as HMRC was unable to complete its enquiries as to whether duty had been paid on them within a reasonable time. The respondents sought judicial review in relation to the returned goods on the basis that the power to detain goods under the Customs and Excise Management Act 1979, s 139 (1) arose only for goods that were, as a matter of established fact, liable to forfeiture, in this case due to unpaid duty. HMRC contends that s 139(1) can be used to detain goods when it reasonably suspects that duty has not been properly paid, pending investigation.
On Wednesday 27 November 2013 the Supreme Court will hand down judgment in the following: Bull & Anor v Hall & Anor, and Zoumbas v Secretary of State for the Home Department.
In the Privy Council on Thursday 28 November 2013 is the Jamaican appeal of Lawrence v The Queen. The issues to be determined include determination of good character, incompetence of trial counsel, dock identification, and admissibility of evidence against one co-defendant when the other co-defendant is acquitted.
