On appeal from: [2012] EWCA Civ 415.
By a majority, the Limitation Act 1980, s 21(1)(a) did not disapply the statutory limitation period for actions against accessories to a fraudulent breach of trust. S 21 was concerned only with actions against true trustees, and a constructive trust of the kind alleged against the Bank is not a true trust but merely a basis for granting equitable relief.
