On Monday 9 February 2015 the Court will hand down judgments in Recovery of Medical Costs for Asbestos Diseases (Wales) Bill – Reference by the Counsel General for Wales involving whether the National Assembly for Wales has the power to enact the Recovery of Medical Costs Asbestos Diseases (Wales) Bill, and Sustainable Shetland v The Scottish Ministers & Anor regarding the decision by the respondents to grant consent for the construction and operation of a wind farm. These will be handed down in Court 1 from 9.45am.
On Monday the Court will also hear the appeal of Coventry & Ors v Lawrence & Anor regarding whether parts of the costs regime introduced by the Access to Justice Act 1999, and in particular a claimant’s right to recover any success fee and ATE premium from an unsuccessful defendant, infringed the rights under ECHR, art 6 and/or A1P1. It will be heard in Court 1 at 11am and will continue on Tuesday for the morning and all day Thursday from 10.30am.
On Wednesday 11 February 2015 the Court will hear the appeal of Woolway v Mazars regarding how to determine whether non-domestic premises constitute one or more than one hereditament for the purposes of the rating list.. It will be heard in Court 1 from 10.30am.
