From Monday 7 October to Wednesday 9 October, the Supreme Court will hear the appeal of Micula & Ors v Romania. This case addresses whether the High Court has the power to stay the enforcement of an award given in accordance with the procedure in the International Convention on the Settlement of Investment Disputes between States and Nationals of Other States (ICSID). This will be heard in Courtroom 1 at 11:00, 10:30 and 10:30 on the respective days.
On Monday 7 October and Tuesday 8 October, the Court will also hear the appeal of R (DN (Rwanda)) v Secretary of State for the Home Department. It will consider (1) whether R (on the application of Draga) v Secretary of State for the Home Department [2012] EWCA Civ 842 was correctly decided and (2) whether the Court of Appeal in this case was, in fact, bound for the reasons it gave to follow Draga. This will be heard in Courtroom 2 at 11:00 on Monday and 10:30 on Tuesday.
On Thursday 10 October 2019, the Court will hear the appeal of Duval v 11-13 Randolph Crescent Ltd. This appeal will consider whether a landlord of a block of flats is entitled, without breach of covenant, to grant a licence to a lessee to carry out work which would breach an absolute covenant contained in a lease of her flat, where the leases of other flats on similar terms require the landlord to enforce covenants at the request of a lessee of one of those other flats. This will be heard in Courtroom 2 at 10:30.
On Thursday 10 October 2019, the Privy Council hear the appeal of Magner & Anor r v Royal Bank of Scotland International Ltd (Gibraltar). This appeal will consider whether the Court of Appeal should have ordered a retrial in a case where the appellants’ solicitors stole approximately £6.9m plus interest from the appellants’ client accounts with RBS.
