On Tuesday 7 May, the Supreme Court will hear the appeal of Patel v Secretary of State for the Home Department; Secretary of State for the Home Department v Shah. This appeal will consider whether the CJEU decision in Chavez-Vilchez (C-113/15) altered the approach to the question of derivative claims for residence in the UK by those without rights of residence, based upon their care of British citizens who are their ‘direct relatives’. This will be heard in Courtroom 2.
On Wednesday 8 May, the Supreme Court will hear the appeal of Garcia v Marex Financial Ltd. This appeal will consider whether the rule against reflective loss bars creditors of a company from claiming directly against a third party for asset-stripping the company. This will be heard in Courtroom 1.
On Thursday 9 May, the Judicial Committee of the Privy Council will hear the appeal of Bergan v Evans (St Christopher & Nevis). This appeal will consider whether a claimant’s expert medical evidence was admissible on the basis that the claimant had not complied with CPR Part 32, where (i) the relevant parts of the defendant’s defence had been held not to be a sufficient response for the purposes of CPR 10.6(2); or (ii) the defendant had not objected to it pursuant to the Evidence Act 2011, s 163. This will be heard in Courtroom 3.
