On Wednesday 8 July 2015 the Supreme Court will hand down judgment in the following: R (Cornwall Council) v Secretary of State for Health; R (Cornwall Council) v Somerset County Council regarding the proper approach to the determination of a person’s “ordinary residence” within the meaning, and for the purposes, of the National Assistance Act 1946, pt III, where that person lacks capacity to decide where to live; Cameron Mathieson, a deceased child (by his father Craig Mathieson) v Secretary of State for Work and Pensions concerning the suspension of a payment of Disability Living Allowance to the appellant after he had been in hospital for 84 days and whether this breached his rights under the ECHR, arts 8 & 14; and Commissioners for Her Majesty’s Revenue and Customs v The Rank Group PLC regarding whether the element of chance in a slot machine connected to a detached random number generator which is used by several such machines is ‘provided by means of the machine’. These will be handed down in Court 2 from 9.45am.
On Thursday 9 July the Court will hear the appeal of R v McGeough (Northern Ireland) concerning whether the Court of Appeal erred in law in refusing to exclude admissions made by the appellant in the course of his application to Sweden for asylum in his trial for attempted murder of postman and Ulster Defence Regiment member, Samuel Brush. The appellant was thought to be one of the two IRA members involved in the incident because of a handwritten letter submitted in support of the asylum application where he admitted shooting “a British Army officer” in the chest in circumstances akin to those involving the attempted murder of Mr Brush. It will be heard in Court 2 from 11am.
On Tuesday 7 July the Privy Council will hear the appeal of Mungalsingh v Juman (Trinidad and Tobago) involving whether the respondent purchaser was entitled to delay completion of a contract for the sale of land pending provision of documents by the appellant vendor, when such documents were not required to be provided by the appellant under the terms of the contract. This will be heard in Court 3 from 10.30am.
