On Tuesday 6 November, the Supreme Court will hear the appeal of UKI (Kingsway) Ltd v Westminster City Council & Anor. This appeal will consider the validity of the service of a completion notice under the Local Government Finance Act 1988, Sch 4A by the appellant on the respondent. This will be heard in Courtroom 2.
On Wednesday 7 and Thursday 8 November, the Judicial Committee of the Privy Council will hear the appeal of Volaw Trust and Corporate Services Ltd and its Directors & Ors v The Office of the Comptroller of Taxes & Anor. This appeal will consider the right or privilege against self-incrimination under Jersey customary law and ECHR, art 6. This will be heard in Courtroom 1.
On Wednesday 7 November, the Supreme Court will hand down the judgment in Barnardo’s v Buckinghamshire & Ors. The proposed panel for hand down is Lady Hale, Lord Hodge and Lord Lloyd-Jones. This appeal considered the proper construction of terms of a Pension Scheme: whether Trustees have the power to adopt an alternative index from the Retail Prices Index, when RPI remains an officially published index, notwithstanding RPI having been superseded (and in that sense ‘replaced’) but the Consumer Price Index as the Government’s front-line inflation measure (including for the purposes of pensions’ uprating).
