On Monday 26 October, the Supreme Court will hear the appeal of Hurstwood Properties (A) Ltd and Ors v Rosendale Borough Council and Anor. This appeal will consider whether the respondents should still be liable to pay non-domestic rates (‘NDR’) for periods when they leased their unoccupied properties to special purpose vehicle companies (‘SPVs’) on the basis that: (1) the leases were prearranged tax avoidance schemes and the relevant statute should be interpreted accordingly; or (2) the SPVs can be disregarded by a piercing of the corporate veil.
On Wednesday 28 and Thursday 29 October, the Supreme Court will hear the appeal of In the matter of T (A Child). This appeal will consider whether, in circumstances where insufficient places are available in registered secure children’s homes, the exercise of the inherent jurisdiction to authorise a child’s placement in unregistered secure accommodation is lawful.
On Friday 30 October, the Supreme Court will hand down two judgments. The first is Stoffel & Co v Grondona. The proposed panel for hand down is Lord Reed, Lord Hodge, Lady Black, Lord Lloyd-Jones, and Lady Arden. The appeal considered whether the Court of Appeal erred in its application of the Patel v Mirza guidelines.
The second judgment to be handed down is Ecila Henderson (A Protected Party, by her litigation friend, The Official Solicitor) v Dorset Healthcare University NHS Foundation Trust. The proposed panel for hand down is Lord Reed, Lord Hodge, Lady Black, Lord Lloyd-Jones, Lady Arden, Lord Kitchin, and Lord Hamblen. The appeal considered whether a claimant who, during a serious psychotic episode, committed a criminal offence which she would not have committed but for the defendant’s negligence, can recover the damages for the consequences of having committed the offence, including her subsequent loss of liberty.
The hand-downs will be streamed on Supreme Court Live and will then be made available on the Supreme Court’s video on demand service.
