On Tuesday 27 November, the Supreme Court will hear the appeal of Perry v Raleys Solicitors. This appeal will consider, where a solicitor negligently fails to advise a client of a potential claim against a third party, and where that client then brings a claim against the solicitor seeking damages for the lost opportunity to pursue the former claim: whether the client must prove, on the balance of probabilities, that the former claim would have been an honest claim. The Court will also consider in which circumstances an appellate court should interfere with a trial judge’s finding of fact. This will be heard in Courtroom 2.

On Wednesday 28 November, the Supreme Court will hear the appeal of Cameron v Liverpool Victoria Insurance Co Ltd. This appeal will consider whether a claimant is entitled to bring a claim for damaged against an unnamed defendant if the claimant has been the victim of an unidentified hit-and-run driver, and the car the unidentified driver was driving is covered by an insurance policy, albeit one in the name of someone untraceable. This will be heard in Courtroom 2.

On Tuesday 27 November, the Judicial Committee of the Privy Council will hear the appeal of Francis & Anor v Vista Del Mar Developments Ltd (Cayman Islands). This appeal will consider the ownership of a parcel of land – in particular, the enforceability of an option contained in the contract of sale concerning the ability of the original seller of the land to reacquire the land from the original purchasers at the price the purchasers paid for the land in May 2009. This will be heard in Courtroom 3.

On Wednesday 28 November, the Supreme Court will hand down the judgment in R (Stott) v Secretary of State for Justice. The proposed panel for hand down is Lady Hale, Lord Carnwarth and Lady Black. This appeal considered whether, but for the House of Lords decision in R (Clift) v Secretary of State for the Home Department [2007] 1 AC 484, the statutory provisions on release of extended determinate sentence prisoners are discriminatory and incompatible with art 14.

On Wednesday 28 November, the Supreme Court will hand down the judgment in Secretary of State for Justice v MM. The proposed panel for hand down is Lady Hale, Lord Carnwarth and Lady Black. This appeal considered whether a detained mental health patient with capacity should be permitted to offer his consent to the First Tier Tribunal imposing conditions as part of his conditional discharge, where the proposed conditions satisfy the objective elements of a deprivation of liberty for the patient.
