On Monday 24 and Tuesday 25 June, the Supreme Court will hear the appeal of R v TRA. This appeal will consider what the correct interpretation is of the term ‘person acting in an official capacity’ in the Criminal Justice Act 1988, s 134(1). In particular, it will consider whether it includes someone who acts otherwise than in a private and individual capacity for or on behalf of an organisation or body which exercises or purports to exercise the functions of Government over the civilian population in the territory which it controls and in which the relevant conduct occurs. This will be heard in Courtroom 2.

On Thursday 27 June, the Supreme Court will hear the appeal of Test Claimants in the Franked Investment Income Group Litigation & Ors v Commissioners of Inland Revenue. This appeal will consider the compatibility of UK corporate taxation with certain principles of EU law and the liabilities of the revenue to a taxpayer who has overpaid tax on the basis of incompatible UK legislation. It will also consider issues arising out of the case of Prudential Assurance Company Ltd v Commissioners for HMRC [2018] UKSC 39. This will be heard in Courtroom 2.
