On Monday 21 November until Thursday 24 November, the Supreme Court will hear the appeal of Lowick Rose LLP (in liquidation) v Swynson Ltd & Anor and Globalia Business Travel SAU of Spain v Fulton Shipping Inc in a joint appeal. This will consider whether the CA erred in law in holding that a lender could recover damages from its negligent adviser representing loans that had been repaid by the borrower on the basis that the borrower’s repayments were collateral to the adviser’s breach of contract, and what the correct measure of shipowners’ damages is following acceptance of a charterers’ repudiatory breach of charter. This will be heard in Courtroom 1, the court sitting from 10am on Monday and Tuesday, and from 10.30am on Wednesday and Thursday.
On Thursday 24 November, the Supreme Court will hear the application of Denise Brewster for Judicial Review (NI). This will consider whether the requirement of the Local Government Pension Scheme (Benefits, Membership and Contributions) Regulations (Northern Ireland) 2009 that unmarried partners be nominated in order to be eligible for a survivor’s pension is disproportionate or irrational. This will be heard in Courtroom 2.
