On Monday 19 June, the Supreme Court will hear the appeals of R v M; R v C; R v T. These appeals will consider whether a criminal offence can be committed under the Trade Marks Act 1994, s 92(1)(b) or (c) (selling, offering for sale or distribution/possession with a view) where the proprietor of the registered trade mark has given its consent to the application of the sign which is its registered trade mark or has itself applied its own registered trade mark to the goods, but has not given its consent to the sale, distribution or possession of them. This will be heard in Courtroom 1.

On Tuesday 20 June, the Supreme Court will hear the appeal of MT Hojgaard AS v E.On Climate UK Robin Rigg East Ltd & Anor. This appeal will consider whether a contract for the design and installation of foundations for an offshore windfarm imposed a fitness for purpose obligation on the contractor amounting to a warranty that said foundations would have a service life of 20 years. This will be heard in Courtroom 1.

On Tuesday 20 June, the Supreme Court will hear the case of In the matter of an application by Jason Loughlin for Judicial Review (Northern Ireland). This will consider whether, in exercising the discretion in the Serious Organised Crime and Police Act 2005, s 74(3)(b), the Special Prosecutor is required to ask himself whether the sentencing court could conclude that the circumstances applicable when the sentence as passed had changed as a result of knowing failures by the assisting offender to give assistance in accordance with the assisting offender agreement. This will be heard in Courtroom 2.

On Wednesday 21 until Thursday 22 June, the Supreme Court will hear the appeal of R (HC) v Secretary of State for Works and Pensions & Ors. This appeal will consider whether the statutory instruments which provide that Zambrano carers are not entitled to social benefits in the UK are unlawful, in particular whether they entail discrimination under EU law or the ECHR which cannot be justified, and whether the resolution of these points of law requires a reference to the CJEU. This will be heard in Courtroom 2.

On Wednesday 21 June, the Judicial Committee of the Privy Council will hear the appeal of Persad v Singh (Trinidad & Tobago). This appeal will consider the circumstances in which the corporate veil can be pierced. This will be heard in Courtroom 3.

 

On Thursday 22 June, the Supreme Court will hear the appeal of R (De Silva & Anor) v The Commissioners for HMRC. This appeal will consider whether HMRC was entitled to enquire into the appellants’ claims for loss relief otherwise than by opening an enquiry under the Tax Management Act 1970, Sch 1A, which is subject to a time limit that had elapsed prior to the date of the enquiry. This will be heard in Courtroom 1.
