On Monday 15 June and Tuesday 16 June 2020, the Supreme Court will hear the appeal of Shagang Shipping Company Ltd (in liquidation) v HNA Group Company Ltd. This appeal will consider, inter alia, whether the Judge had made a finding that torture had not been proved on the balance of probabilities as well as the correct treatment of hearsay evidence in a civil trial where the possibility of torture cannot be ruled out.
On Wednesday 17 June 2020, the Supreme Court will hand down judgment in the case of Sainsbury’s Supermarkets Ltd v Visa Europe Services LLC & Ors. This appeal considers, inter alia, whether the Court of Appeal erred in law in finding that the multilateral interchange fees at issue amounted to a restriction of competition in the acquiring market contrary to TFEU, Article 101 (1).
On Wednesday 17 June 2020, the Supreme Court will also hand down judgment in the case of Bresco Electrical Services Ltd (in liquidation) v Michael J Lonsdale (Electrical) Ltd. This appeal considers whether the court should grant an injunction to restrain a company in insolvent liquidation from referring a dispute with a cross-claiming creditor to adjudication and whether an adjudicator has jurisdiction to decide such a dispute.
On Thursday 18 June 2020, the Supreme Court will hand down judgment in ABC (AP) v Principal Reporter & Anor (Scotland). This appeal will consider whether a declaration of incompatibility should be made in respect of the Children’s Hearings (Scotland) Act 2011, s 81 (3).
On Thursday 18 June 2020, the Supreme Court will hand down judgment in In the matter of XY (Scotland). This appeal will consider whether the provisions of the Children’s Hearings (Scotland) Act 2011 violate Articles 6 and 8 of the ECHR and whether a declaration of incompatibility should be made in respect of the provisions.
On Wednesday 17 June and Thursday 18 June 2020, the Privy Council will hear the appeal of National Stadium (Grenada) Corporation v NH International (Caribbean) Ltd (Trinidad and Tobago.) This appeal will consider, inter alia, whether Clico Bank held US $ 2.8 m on trust for the contractor.
