On Monday 12 and Tuesday 13 July, the Supreme Court will hear R (on the application of Elan-Cane) v Secretary of State for the Home Department. This appeal will consider whether the Court of Appeal was wrong in its conclusion that Her Majesty’s Passport Office’s Policy that (i) an applicant for a passport must declare their gender/sex as being either male or female and (ii) a passport will only be issued bearing a male or female indicator in the gender/sex field on the face of the passport and will not be issued with an “unspecified” gender marker does not unjustifiably breach articles 8 and 14 of the European Convention on Human Rights.
On Thursday 15 July, the Supreme Court will hear A Local Authority v JB (by his Litigation Friend, the Official Solicitor) (AP). This appeal will consider whether, to have capacity to decide to have sexual relations with another person, a person needs to understand that the other person must have the capacity to consent to the sexual activity and must in fact consent before and throughout the sexual activity.
On Friday 16 July, the Supreme Court will hand down judgment in two cases. First, Triple Point Technology Inc v PTT Public Company Ltd. Second, Sanambar v Secretary of State for the Home Department.
