On Tuesday 2 May, the Judicial Committee of the Privy Council will hear the appeal of Alves v AG of the Virgin Islands (British Virgin Islands). This will consider whether the Claimant’s claim was statute barred by reason of the provisions of the Public Authorities Protection Act, s 2, in that the negligence by the Government causing the injury to the Claimant occurred in the direct discharge of its public duty or direct exercise of its authority to provide hospital services under the Public Hospital Act. It will also consider whether there is a private duty owed by the State to a Government employee which is separate from the public duties being performed by the State. This will be heard in Courtroom 3.
On Wednesday 3 May and Thursday 4 May, the Supreme Court will hear the appeal of P v Commissioner of Police of the Metropolis. This will consider whether police officers are entitled to bring discrimination claims in the Employment Tribunal in respect of dismissals following proceedings before a Misconduct Panel. This will be heard in Courtroom 2.
On Wednesday 3 May and Thursday 4 May, the Judicial Committee of the Privy Council will hear the appeal of Fair Trading Commission v Digicel Jamaica Ltd & Anor. This will consider whether the Fair Competition Act, s 17 applies to the agreement between the Respondents dated 11 Mar 2011 (alternatively to the mergers and acquisitions in this case). It will also consider whether the Fair Competition Act, s 17 applies to an agreement where transactions arising from it are approved by a Minister pursuant to the Telecommunications Act, s 17. This will be heard in Courtroom 3.
