On Wednesday 11 November, the Supreme Court will hear the case of A and B v Criminal Injuries Compensation Authority and Anor. This appeal will consider whether excluding A and B, who are victims of human trafficking, from compensation under the Criminal Injuries Compensation Scheme unjustifiably discriminates against A and B, in breach of Article 14 taken with Article 4 of the European Convention on Human Rights.
On Thursday 12 November, the Supreme Court will hear the case of Triple Point Technology Inc v PTT Public Company Ltd. This appeal will consider issues surrounding liquidated damages and limitation of liability clauses.
On Friday 13 November, the Supreme Court will hand down judgment in R (on the application of Maughan) (AP) v Her Majesty’s Senior Coroner for Oxfordshire. The proposed panel for hand-down is Lord Reed, Lord Kerr, Lord Wilson, Lord Carnwath, and Lady Arden. The appeal considered two issues. First, whether the applicable standard of proof in inquest proceedings in the case of suicide the balance of probabilities (the civil standard) or beyond reasonable doubt (the criminal standard). Second, if the answer depends on whether the determination is expressed as a short-form conclusion or a narrative conclusion.
The hand-downs will be streamed on Supreme Court Live and will then be made available on the Supreme Court’s video on demand service.
