Listed for two days from this morning is the appeal of Cox v Ergo Versicherung AG (formerly known as Victoria) in front of L Neuberger, L Mance, L Sumption, L Toulson, and L Hodge. The appellant’s husband had been posted in Germany with HM Forces, when he was knocked off his bicycle near his barracks and died from his injuries. The driver of the car was resident in Germany, and had third-party insurance with the German-registered respondent company. The appellant started proceedings in England against the respondent, including a claim for damages, arguing that the quantification of damages recoverable from the respondent is governed entirely by English law, and, in particular, by provisions of the Fatal Accidents Act 1976.

From Wednesday until Thursday 23 Jan is the matter of A v Secretary of State for the Home Department (Scotland). There are no UKSC case details currently available for this case, but our summary is available here. The issue for the Supreme Court is whether the discretion to prohibit publication of a name or other material in connection with court proceedings under s 11 of the Contempt of Court Act 1981 was correctly exercised in a case concerning judicial review of a deportation order.

There are two hearings in the Privy Council this week. This morning in Courtroom 3 is the Mauritian appeal of Piganiol v Smegh (Ille Maurice) Ltee, concerning a rescission order. On Thursday in Ramdeen v The State the Judicial Committee will consider a death penalty appeal on the basis of inadequacies in directions to the jury and evidence.
