Appellant young Somalis were appealing against the refusal of entry clearance which would have permitted them to enter the UK to live with their cousin, who sponsored their application. The issue in question related to the effect of the Nationality, Immigration and Asylum Act 2002, s 85(5), which excludes matters arising since the refusal of entry clearance from consideration in the event of an appeal to the tribunal, and whether the provision was compatible with ECHR, art 8
