An application to set aside a Reporting Restriction Order was granted. A continuing ECHR, art 8 right to privacy for the protected individual was not upheld, as the balance fell in favour of the BBC’s right to free expression under the ECHR, art 10.

Considers whether the House of Lords had power to make an anonymity order; and if so, whether it should now be discharged on the grounds that it violates the BBC’s ECHR, art 10 rights. The second issue was whether the protected individual is entitled to invoke the protection of ECHR, art 8 against it being set aside. Order discharged.
