On Monday 9 until Tuesday 10 October, the Supreme Court will hear the appeal of In the matter of C (Children). This appeal will consider whether ‘anticipatory retention’ is a concept recognised under the Convention of 25 October 1980 on the Civil Aspects of International Child Abduction (‘the 1980 Hague Convention’). This will be heard in Courtroom 2.

On Tuesday 10 October, the Supreme Court will hear the appeal of Love v ELB Securities Ltd (Scotland). This appeal will consider whether, where there has been a disclaimer by the Queen’s and Lord Treasurer’s Remembrancer of any interest in a lease held by a dissolved company and that company is subsequently restored to the Register of Companies, the Companies Act 2006, s 1032(1) has the effect that the lease is deemed to have always continued in existence or whether the notice of disclaimer has the effect of bringing the lease to an end. This will be heard in Courtroom 3.

On Wednesday 11 until Thursday 12 October, the Supreme Court will hear the appeal of Morris-Garner v One Step (Support) Ltd. This appeal will consider the circumstances in which it is permissible to award damages measured as a percentage of the defendant’s profits resulting from a defendant’s breach of a restrictive covenant. This will be heard in Courtroom 2.

On Wednesday 11 until Thursday 12 October, the Judicial Committee of the Privy Council will hear the appeal of Deslauriers & Anor v Guardian Asset Management Ltd (Trinidad & Tobago). This appeal will consider whether the Court of Appeal was wrong to uphold the decision that no misrepresentation or negligent misstatement had been made. It will also consider whether the Court of Appeal failed to deal with the Judge’s decision that the Remedies of Creditors Act provided no discretion to the court on the respondent’s application, when in fact it did; whether it was wrong to order possession of Victoria Square, given that the respondent already has the right to sell Hevron Heights with vacant possession and satisfy its debt from that source; and whether it was wrong to give possession of the property without due regard to the appellants’ right to be represented by counsel and their constitutional right to a fair hearing prior to reaching a decision. This will be heard in Courtroom 3.
