On Monday 8 February, the Supreme Court will hear the case of Burnett or Grant v International Insurance Company of Hanover Limited. For the purpose of interpreting a contract for public liability insurance provided by Hanover (the “Policy”), the Supreme Court is asked to consider whether the death of Ms Burnett’s husband: (1) was brought about by a “deliberate act” within the terms of the Policy and, if so, whether Hanover’s liability to indemnify is excluded by the relevant policy wording; and (2) was a consequence of a “wrongful arrest” within the terms of the Policy with the effect that Hanover’s liability is limited to GBP 100,000.

On Wednesday 10 February, the Supreme Court will hear the case of R (on the application of A) v Secretary of State for the Home Department. The appeal will consider whether the Multi Agency Public Protection Arrangements guidance is unlawful.

On Friday 12 February, the Supreme Court will hand down two judgments. The first is Okpabi and Ors v Royal Dutch Shell Plc and Anor. This appeal considered whether and in what circumstances the UK-domiciled parent company of a multi-national group of companies may owe a common law duty of care to individuals who allegedly suffer serious harm as a result of alleged systemic health, safety and environmental failings of one of its overseas subsidiaries as the operator of a joint venture operation.

The second is T W Logistics Ltd v Essex County Council & Anor. This appeal considered how the legislation prohibiting various activities on town or village greens interacts with the registration regime, given the rule that the public’s activities on the land before registration may co-exist with those of the landowner, and must do after registration.
