In Courtroom 1 this week is the appeal of Abela & Ors v Baadarani, listed from Wednesday 10 until Thursday 11 April. In this matter the appellants sought to sue the respondent for alleged fraud relating to a contract. The claim form was issued and permission to serve the claim on the respondent out of jurisdiction was granted, in addition to various extensions and an order for alternative service. Just before the limitation period expired the claim was delivered to the respondent’s representation in Lebanon, which did not constitute good service under Lebanese law. The High Court retrospectively validated it as good service, which was overturned by the Court of Appeal in addition to the other orders. It is for the Supreme Court to determine what principles govern applications for retrospective validation of alternative service out of jurisdiction, and applications for a time extension for service of a claim form and to dispense with service.
