On Tuesday 8 and Wednesday 9 May, the Supreme Court will hear the appeal of R (Hallam) v Secretary of State for Justice; R (Nealon) v Secretary of State for Justice. This appeal will consider whether the definition of a ‘miscarriage of justice’ in the Criminal Justice Act 1988, s 133(1ZA), which has the effect of restricting awards of compensation to cases in which a new or newly discovered fact shows beyond reasonable doubt that the person did not commit the offence, is incompatible with the presumption of innocence in ECHR, art 6(2). This will be heard in Courtroom 1.

On Thursday 10 May, the Supreme Court will hear the appeal of JP Whitter (Water Well Engineers) Ltd v Commissioners for HMRC. This appeal will consider whether, when HMRC exercise discretion to cancel gross payment registration, they are required to consider the impact on the person holding that registration. This will be heard in Courtroom 1.
