On Tuesday 1st November to Thursday 3rd November, the Supreme Court will hear the joint appeals of China National Chartering Company Ltd v Gard Marine and Energy Ltd & Anor, Gard Marine and Energy Ltd v China National Chartering Company Ltd & Anor, and Daiichi Chuo Kisen Kaisha v Gard Marine and Energy Ltd & Anor. This will consider whether as a matter of law in the circumstances there was a breach of a safe port warranty.
On Wednesday 2nd November, the Supreme Court will hear the case of R (A) (A Child) (by her litigation Friend B) v Secretary of State for Health. This will consider whether the Secretary of State acted unlawfully in failing to require abortion services to be provided through the NHS in England ordinarily resident in Northern Ireland, and whether failing to do this infringes ECHR, arts 14 & 8.
On Thursday 3rd November, the Supreme Court will hear the case of Volkswagen Financial Services (UK) Ltd v Commissioners for Her Majesty’s Revenue and Customs. This will consider what a fair and reasonable apportionment of residual input tax on costs incurred in retail from hire purchase transactions combining VAT taxable and VAT exempt supply is under the ‘partial exempt special method’ agreed by the parties.
