On Wednesday 2 August, the Supreme Court will hand down the judgment in the case of R (Forge Care Homes Ltd & Ors) v Cardiff & Vale University Health Board & Ors. This appeal considered whether the NHS (through Local Health Boards) is required to fund registered nurses in care homes only when they are providing nursing care or also when they are providing social care to social residents.

On Wednesday 2 August, the Supreme Court will hand down the judgment in the case of Goldtrail Travel Ltd (In Liquidation) v Onur Air Tasimacilik AS. This appeal considered in what circumstances a court should take into account the position of third parties who might be in a position to fund a litigant, when considering whether that litigant’s claim or defence is likely to be stifled by a requirement that it post security for costs.

On Thursday 3 August, the Supreme Court will hand down the judgment in the case of R v M; R v C; R v T. This appeal considered whether a criminal offence can be committed under the Trade Marks Act 1994, s 92(1)(b) or (c) (selling, offering for sale or distribution/possession with a view) where the proprietor of the registered trade mark has given its consent to the application of the sign which is its registered trade mark or has itself applied its own registered trade mark to the goods, but has not given its consent to the sale, distribution or possession of them.

On Thursday 3 August, the Supreme Court will hand down the judgment in the case of MT Hojgaard A/S v E.On Climate & Renewables UK Robin Rigg East Ltd & Anor. This appeal considered whether a contract for the design and installation of foundations for an offshore windfarm imposed a fitness for purpose obligation on the contractor amounting to a warranty that said foundations would have a service life of 20 years.

Lord Neuberger’s ‘valedictory’ speech has been reported in The Times (paywall) in which he stated that the “high quality” of Britain’s judiciary is threatened without adequate financial and political support.

The Belfast Telegraph has reported that the Supreme Court is due to sit in Belfast for the first time next year.
