Two appeals are to be heard in the Supreme Court this week.  First, there are the linked cases R (on the application of GC) v The Commissioner of Police of the Metropolis and R (on the application of C) v The Commissioner of Police of the Metropolis, being heard from Monday 31 January to Tuesday 1 February. The appeal will be heard by Lords Phillips and Rodger, Lady Hale, Lords Brown, Judge, Kerr and Dyson and the issue is whether the continued retention of the DNA, fingerprints and a photograph of GC and of the DNA, fingerprints and information on the police national computer in respect of C, violates their rights under Article 8 of the European Convention on Human Rights. The second appeal In the matter of an application by Brigid McCaughey and another for Judicial Review (Northern Ireland) will be heard on Wednesday 2 to Thursday 3 February by Lords Phillips, Hope and Rodger, Lady Hale and Lords Brown, Kerr and Dyson. The case is concerned with whether there is an obligation to conduct an Article 2 ECHR-compliant inquest into deaths and subsequent investigations which occurred before the commencement of the Human Rights Act 1998; and whether the decision in Re McKerr should be overruled in the light of the Grand Chamber decision in Silih v Slovenia. The Supreme Court has announced judgments will be handed down on Tuesday 1 February 2011 in the cases of ZH (Tanzania) (FC) v Secretary of State for the Home Department, heard 9-10 November 2010; and Global Process Systems Inc and another v Syarikat Takaful Malaysia Berhad, heard 28 July 2010 (here is our case preview for Global Process Systems).

In the Privy Council, on Monday 31 January to Tuesday 1 February, Lords Hope, Mance, Collins, Clarke and Reed will heard Tasarruf Mevduati Sigorta Fonu v Merrill Lynch Bank and Trust Company (Cayman) Limited & Others. The case from the Cayman Islands concerns the enforceability of a judgment by a creditor against a settlor of a trust through the power of revocation held by the settlor.
