From Monday, hearings in the Supreme Court are now shown live on the Court’s website.

Also today, the Court will hear the appeal of Al-Saud v Apex Global Management Ltd & Anor. The case regards the refusal by a Saudi Arabian Royal Family member to comply with an order to sign a witness statement pertaining to disclosure matters on the grounds that his status prevented him from doing so. All of his previous challenges against the orders have failed. The Supreme Court must decide what action is appropriate when deciding whether to stay a default judgment entered following breach of an unless order. This will be heard in Court 1 at 11am.

From Tuesday 14 October the Court will hear the appeal of Jetivia SA & Anor v Bilta (UK) Ltd & Ors. This concerns the liquidation of the company Bilta (UK) Ltd and the conduct of its directors and sole shareholder. The Court must decide whether a company’s participation in fraudulent conspiracy leading to insolvency prevents the company from bringing a claim against other conspirators on the grounds of ex turpi causa; whether a director’s breach of duty which stems from the threat of insolvency due to their need to have regard of creditors cannot be attributed to the company; and whether the Insolvency Act 1986, s 213, applies without territorial limitation and whether its jurisdictional limitations fall to be assessed at the conclusion of the trail. This will be heard in Court 1 for two days from 10.30am each day.

Graughran v The Chief Constable of the Police Service of Northern Ireland will be heard in Court 2 from 10.30am on Thursday 16 October 2014. This case concerns the indefinite retention of fingerprints, photographs, DNA samples and DNA profiles of an individual convicted in Northern Ireland. The appellant sought to get the samples destroyed but the police refused. The Court must decide whether the indefinite retention is an interference with the ECHR, art 8(1) and if so, whether that interference could justified in accordance with art 8(2).

The Privy Council will hand down judgment in Lovell Romain v The Police Service Commission on Monday, on the regulations regarding the procedure of making promotions. It will also hear the appeal of Alleyne & Ors v The A-G of Trinidad and Tobago regarding whether the constitutional rights of Municipal Police Officers in Trinidad and Tobago were infringed by the failing to make regulations which ensured their enjoyment of property, protection of law, freedom of association, procedural protection and right to equality of treatment. These cases will both be heard in Court 3. On Thursday 16 October it will hand down judgment in Fortis TCI Ltd v Islandcom Telecommunications Ltd, determining whether the respondent had lawfully used the microwave spectrum bands its cellular telephone system and Automatic Meter Reading meters. It will also hear the appeal in Dixon v Kingdom of Spain regarding the European Arrest Warrant issued against the appellant and its failure to specify the correct charge under Spanish Law. This case will be heard in Court 3 at 10.30am following the judgment in Fortis.
